If this is true, it's amazing. This man continues to undermine the very fabric of this country, our constitutional form of government. One would expect a sequence of events such as these out of Venezuela not the United States. Shameful!

Hussein keeps pushing the envelope to keep his voters entertained. What will happen when the king opts not to reply? Nothing. And that is where he shows his voters who is really king in this country. He can and does whatever he wants, laws and constitution be damned.

As much as I blasted the Administration for its statements (check my posts) this is a bad move by the 5th Circuit. The President is a politician. While his comments were horribly wrong, they are still in a political context, and he did not say he would refuse to follow a decision. This looks like the judges are taking sides in a purely political rhetorical war, and I think that's a bad move.

What Obama believes is utterly immaterial.

The SCOTUS WILL invalidate the administration’s healthcare legislation.

There is absolutely nothing Obama can do about it, unless he stages a coup, declares the constitution invalid, and assumes the powers of a dictator.

Personally, I wouldn’t put it past him to try it.

Obama contends (1) it would be unprecedented for the Supreme Court to strike down as unconstitutional a law passed by Congress and (2) Obamacare was passed by "a strong majority of ... Congress."

Both points are prime examples of the historical revisionism that the left so frequently engages in. Even the CBS writer of the posted article (as well as any American citizen with a decent knowledge of American history) knows that federal courts have been engaged in vetting the constitutionality of statutes passed by Congress, i.e., "judicial review," since Marbury v. Madison in 1803.

As to the second point, we all know that Obamacare passed the House by a very slim margin and that it passed the Senate by a small margin only via the use of "reconciliation," which averted its defeat by filibuster. "Stong majority"? Anything but!

The serious part of the federal judiciary are still burned up about Marbury v. Madison (1803), that while it was the first time in which the Supreme Court asserted the right to overturn a federal law as unconstitutional, just as importantly, it ordered the president to comply with their order, and he *refused*.

This was a huge increase in the power of the office of the presidency.

This obviously hit a serious nerve with this judge. By Obama challenging the right of the SCOTUS to find a law unconstitutional, he is threatening the balance of power in Washington between the three branches.

Essentially this would mean that the POTUS is supreme and can ignore the SCOTUS. And that is throwing down a gauntlet, big time.

Maybe this poser will manage to tick the USSC off enough that they not only unanimously toss Obamacare, but they then decide to take up the issue of eligibility, and toss Obama out with the Obamacare.
