BEWARE reading ANYTHING into questions by the Justices. I’ve argued before SCOTUS, the VA Sup Ct and several appellate courts and questions don’t mean a whole lot. In fact, Justices will frequently ask questions the opposite of what they are inclined to do to force you to make their argument.

Judicial questions are for one purpose ... to spur discussion. Many times a Judge would grill me on an issue as though he didn’t buy it only to rule in my favor.

Anyone who tells you they can read the tea leaves on this one, or that there are even tea leaves to read, have know idea about what they speak.

All we can do is sit back and wait.

Agree. To hear Jeffrey Toobin describe it as a trainwreck you'd sigh with relief. To listen to Krauthammer give a contrary assessment you realize your opinion is as valid as theirs.

You obviously know a lot more about this then me and 99.99% of people.

When Obamacare was passed, I said that it will be struck down by the SCOTUS and its ironic that the most powerful man is a Kennedy. Not John or Ted but Anthony.

When I heard the questions he asked, I still stand by it.

I agree. I am ready to be disappointed when SCOTUS rules. Sadly, it is up to them. I don’t see us winning the Senate, so it is here to stay unless SCOTUS kills it.

The members of the Court are many times just having a discussion with each other through their questions to the presenting attorney.

I agree. Lots of glad handing by conservatives after yesterday, but what happened yesterday means squat. About the only thing thats a sure bet is that the 4 most liberal justices will give it their stamp of approval. Their minds were already made up before the arguments even began. As for Kennedy and the others? There is a lot of time between now and June. Lots of time for arm twisting. Our only real hope is that they realize that if they ok this, they will be voting to give unlimited power to the other branches of govt. and making their own branch obsolete.

Do you think the fact that there was no “severability” written into the bill will play into any Justice’s decision? I guess, as a neophyte watcher of the Justices....I’m thinking they know if they strike down the mandate, then the lack of a severability clause really strikes down the whole mess, right? So, this mandate decision is REALLY the deciding factor...maybe?

If the supreme court upholds this mess we may as well shut it down and burn the constitution! There will no longer even be room for a pretense of upholding the constitution. I said years ago that it is disgusting to see two major party candidates compete for the presidency by each trying to outdo the other in promising to enact programs that violate the constitution and then the winner swears to uphold the same constitution he has promised over and over to violate in order to win the election. Of course they never admit that they are promising to violate the constitution but anyone with an honest eighth grade education can read the document and figure it out.

I still believe the founders were some of the most brilliant people of all time and possessed an understanding of human nature that is almost unknown today. For anyone, supreme court justices included, to pretend that the founders endured all that they went through to create this country and this constitution and then threw in a couple of catch all phrases which amount to, “Oh, what the hey, just do whatever suits you”, is monumental insanity.
