If Newt fails to win 5 states, are his hard delegates uncommitted?

Rule 40 states that if a person can’t win 5 states, they can’t be put into nomination. I can’t find anything on what happens to their delegates. Maybe you can find specific wording on that. Already though, some Newt delegates have said they are going to Santorum, so there may be no such thing as a hard delegate for the candidate if the can’t even get into nomination.
