Slinger homeowner won't be charged in fatal shooting(WI)

A Slinger homeowner who fatally shot a 20-year-old West Bend man who was hiding from police inside the homeowner's enclosed porch will not be charged, the Washington County District Attorney's Office announced Wednesday.

Bo Morrison was among a group of people who fled from an underage drinking party in a nextdoor garage and was hiding inside the porch when he was shot about 2 a.m. March 3.

The homeowner acted lawfully and in self-defense when he armed himself, encountered Morrison in the darkened room and killed him with a single gunshot from a .45 caliber revolver, the statement says. Authorities have not identified the homeowner.

Wisconsin's castle doctrine law presumes homeowners are justified when using deadly force against intruders.

The law, passed by the Legislature in November, covers places like patios, porches and garages.

According to the district attorney's office report on the incident:

Shortly before 1 a.m. the homeowner was awakened by loud music coming from the property east of his home, walked outside through the back porch and heard loud music coming from a car in a driveway.

After pounding on the car and telling a female inside to turn down the volume he got into a brief verbal confrontation with the car's occupants before going back inside his residence and calling police.

When officers arrived they heard loud music and noise coming from the detached garage but it subsided after police knocked on the garage door.

The officers heard talking and laughing inside the garage and tried forcing their way through the door but it appeared the people inside were holding it shut.

A man who lived in the residence on the property was asleep, so one of the officer's called the man's wife, who was at work, and told her citations would be issued to them

The kid WASN'T partying next door. Uninvited, he snuck INSIDE a neighbors dark house.

Warn your kid about guys like me. We've already planned out, and practiced, just how it's going to end when someone univited sneaks into our house.

There is a price for being stupid, and you just might save your sons life.

I agree. A 20 year old is a man, not a kid. Any man breaking and entering in the middle of the night is taking “his own life into his own hands” and my line of fire!

WOW.

He was in a back porch. No mention that he was trying to make entry into the house.

This guy was seen fleeing the scene . The shooter called the cops, causing the the perp to flee and just waited to see what would happen.

Make my day.

Murderer. And you’re just the same. Congrats, man.

It is 1am and an intruder is inside my back porch. On top of that a couple of houses in my neighborhood have been burglarized at night recently.

A back porch IS part of the house.

Murder is a legal term, and killing someone INSIDE a house isn’t murder, or the shooter would be charged.

Respectfully, your posts indicate a serious lack of understanding of terms and what constitutes self defense.

You owe it to your 20 year old to come to a much better understanding of what happened here, and to pass that along to him.

There’s a father in Colorado Springs who still thinks, 25 years later, that his son had the right to force a 60 old man off the Interstate, lean through the car window and start beat the crap out of him for cutting him off. The son was killed instantly. The shooter was never charged. The father still is agressively defending his sons actions.

Don’t be that kind of a father to your son. He deserves better.

Did you read the entire article?

The shooter did call the cops, whom the partiers ignored. It wasn’t until the person in the house associated with the garage went in and busted down the door and told the folks “the cops have the place surrounded”. Then the 20-year old was seen fleeing - perhaps by the guy that busted down the door, or the other partiers.

I imagine during this time the shooter was inside, wondering what was going on next door. And the next thing he hears is someone down in his porch. He steps out into the porch, and is surprised by the 20-year old hiding between a fridge and a dresser, just behind the door.

It may serve as a reminder though to gun-owners to be clear in their statements to someone under similar circumstances. Instead of a “what are you doing here”, which may have caused the deceased to smile (not seen in the dark), put his hands up (taken as a threat in the dark), and then never being able to say “Oh - hey, no problem, I was just trying to...”

Instead, yell at the person to get on the ground or similar clear command.

The 20-year old may very well not have been a threat - but the homeowner didn’t know that.

The homeowner may have also been afraid from the earlier confrontation at the car where he asked/told them to turn the music down.

I had dropped my son off for a game once, he was about 14. As he and his buddies were goofing around they crossed the street at the sign, and someone yelled “Hey we’re walking here” and some kid touched the hood of the car. Nothing happened - and just stupid kid stuff.

I told my son that night that it is stupid kid stuff to them, but it may have been the last straw for some driver. Worried about keeping his job, rough day at work, stuck in rush-hour, etc. Of course in that case if the kid was beat-up, run-over or shot it would have been illegal. But, he still would be beat-up, run-over or shot.

Exactly what will you do when you discover that a person, willing to break at least one law (breaking and entering), is more than willing to break others?

Violence against you or your family, for example.

Will you ask them nicely to leave?

You are extremely confused about definitions. There IS a difference between killing someone and murder. The difference is there for a reason. Now, you could write your own dictionary and define terms any way you desire. The hard part will be in getting everyone else to accept your definitions. You could call it bigheadfreds’ dictionary. Do not print too many copies though.
