Now he is forced to rule based on the merits. I can't imagine a default judgment if the judge is not convinced by their arguments. He is not going to say “Obama meets all the requirements to be on the ballot but can't be on the ballots because he pissed me off.”

And the Georgia SoS is certainly not going to say “Obama meets all the requirements to be on the ballot but can't be on the ballots because he pissed off a judge.” Since when have judges been so special?

Not showing up makes the judge’s job real easy... facts/evidence is undisputed. Bamm! (gavel cracking judge’s bench)

That doesn't make the facts or evidence true. Orly accused Obama of felony crimes - are you saying that the judge has said he is in fact guilty of those crimes? Don't think so. The facts and the evidence still have to stand on their own regardless of whether they were disputed by Obama or not.

Besides, the article says that they REJECTED a summary judgment. I think by presenting their case they took it off the table - the judge will now make a decision based purely on the merits of the case.

The primary question for consideration is which state will be next to follow Georgia’s lead

It looks like Alabama is on deck.

http://politicalvelcraft.org/2012/01/13/obama-blocked-from-registering-for-alabama-state-primary-until-eligibility-is-validated-by-court/

An Alabama Court has announced that it will hear arguments as to whether Barack Hussein Obama II is in fact eligible to appear on the State Presidential Primary Ballot.

Several Alabama citizens have filed a lawsuit within the Alabama Circuit Court to “prevent certification of President Barack Obama for 2012 Alabama ballot access pending final hearing based on factual evidentiary hearings.”

The deadline for any candidate to register to appear on the Alabama Presidential Primary ballot is just days away, but by agreeing to hear the case, the Alabama Courts have effectively stalled any efforts by the Democratic Party to place Obama on the ballot.
