Following a hearing in Richmond today, U.S. district judge John Gibney ruled against Rick Perry's challenge to the Virginia ballot rules.
In his opinion, Gibney says Perry, and the other candidates who joined the challenge, waited too long to bring the suit.
"They knew the rules in Virginia many months ago; the limitations on circulators affected them as soon as they began to circulate petitions," he writes. "They plaintiffs could have challenged the Virginia law at that time. Instead, they waited until after the time to gather petitions had ended and they had lost the political battle to be on the ballot; then, on the eve of the printing of absentee ballots, they decided to challenge Virginia's laws. In essence, they played the game, lost, and then complained that the rules were unfair."
The decision means Perry, as well as Newt Gingrich, Rick Santorum and Jon Huntsman, will not appear on the ballot in the state's March 6 primary.

How about none of the above (NOTA)? If you don’t like these clowns do a NOTA or write a name in. Depriving them of votes is a perfectly acceptable and effective means of hurting these two.
No way the establishment GOP pukes want Paul. This primary, I am all about pissing those blue-bloods right the hell off.

Not certain of the election process vagaries in VA, or if these candidates messed up with their adherence, BUT
how convenient that Judge Gibney can clear the slate a bit for his boss/patron. Ethical, conflict of interest?

It does not make sense if the question was the constitutionality of the process and the exclusion of candidates.
Something is either unconstitutional or not. The judge can't very well argue, "Yeah, it's unconstitutional, but you gotta do it anyway because you waited to long to complain."

First off, full disclosure: I’m a supporter of the Paul faction.
If you’d asked me three weeks ago, I would have said that Ron Paul was going to seriously consider going third party. Then I realized that I was completely wrong about the objectives of the campaign. The presidency in 2012 isn’t the ultimate goal of Ron Paul or his supporters. The Paul faction has a much bigger fish in mind.
And there isn’t a chance in hades that he’s going third party.
Every VA primary voter should pull the lever for Paul sending a clear messages to the establishment scumbags.

As I understand the judicial ruling,the State of Virginia has very stringent requirements for qualifying to be on the ballot.One might even correctly call them onerous or unfair.
But in order to challenge the requirements successfully, the complaint should have been made at the beginning or middle of the qualification process, not at the end.
The challenge/suit was not made in a timely manner.
Two candidates managed to meet the requirements, and are on the ballot. Many other candidates did not meet or exceed the minimum requirements, and also did not challenge the rules well prior to qualification deadlines. Probably one of the reasons Virginia crafted the ballot requirements in the first place was that the State of Virginia wanted the citizens of Virginia votes to weigh heavily on the nation as an early primary State.The requirements are not “new”. That the validation process regarding signatories to petitions was tightened even further is beside the point.
As a Florida resident, I applauded the decision of the State of Florida, to hold our primary “early”, no matter what sanctions the “National Republican Convention” threatened us with.
In part, because we have a closed party primary, and also because we require all voters to show ID, in order to vote.
Those who claim to be Republicans in Virginia have three choices now.
Romney, Paul, or write “intentionally left blank” on your ballot form.

They weren’t. Heck, their strategic thinking doesn’t seem to go longer than 4 weeks.
Two candidates on the gop ticket were thinking, though. One was mitt romney. The other is Ron Paul and his supporters.

This wasn’t right at all. This was done in a hurry to help Mitt. The Gov and AG there are 100% pro Mitt. What a shame for states right for the citizen (which didn’t matter) The same AG fighting Obamacare.
Correct and that’s why they’re on top. Proper planning prevents poor performance. Luck doesn’t just happen, those two were working for it. That says something and here we are the fractured conservative base left out in the cold again. Do you think they have our number or are we bugged?

Sounds like this is now of extreme unimportance.
Perry should spend next week just touring SC like he were a tourist, instead of the candidate of which he can no longer really claim to be. That way his donors can pay for an extra week’s vacation travel.
