This is a violation of the Constitution in that the line in question speaks of vacancies that occur: The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

This vacancy pre-dated the recess and was already under consideration by the Senate, and Cordray could not clear the hurdles. Obviously, the Senate thought there was no emergency or hurry. They left on vacation.

Unconstitutional because it was not a "happen during recess" issue.

Unconstitutional because the original constitution, with long periods for travel and communication, set this up for emergency vacancies, which this was not.

Unconstitutional because Cordray, even in a recess, cannot be "appointed". He could only be given a commission that automatically expires at the end of the Congressional session.

Congress has the power of the purse strings.....

Simply defund the entire department.

He can appoint all he wants, but where will the funds come from?

This was not a “recess” appointment. Technically the Senate is not in recess but they are all out of town.This appointment should be challenged on those ground but I doubt we’ll see anything from the spineless Repubs.

Obama is just setting precedent for when the Republicans take control. If the next Republican President does something the MSM doesn't like, he can just site the "Obama Rule."

Also, since Harry Reid invoked the "nuclear option" earlier this year, no one can raise a stink when the Republican-controlled Senate does it next year. Its no longer the "Nuclear Option," its the "Reid Option."

The recess appointment means Cordray stands to serve for at least the next two years.

I thought a recess appointment was only good until the end of the current Congress which is the first week of January 2013? Or has Obama fudged that as well?

Obama’s move isn’t even valid under the statute creating the CFPB: The law apparently states that the Director must be confirmed by the Senate and not appointed to trigger empowerment:
