Is not the oil & gas under a person's “property” (land), his PROPERTY (possession). Property (of either type) are tangible assets that he can sell, like a cow, corn, or timber. If the government (illegally) prevents you from selling or decreases the value of your property, is this not a violation of your fifth amendment rights? I think it is.

True, in PA the "mineral rights" may or may not be owned by the owner of the surface land, but you know that before you buy property, it is noted in the bill of sale.
The development of the natural gas in the Marcellus Shale has brought thousands of jobs and billions of dollars of wealth to PA.
If you ignore Philly and Pburg, the unemployment rate in PA is 7% because the rednecks with our guns and Bibles that live in the middle of the state are making money from the drilling. The counties that surround Pittsburgh and Philadelphia have either banned or made it impossible to get permits for drilling so they get no direct money.
My personal home usage gas bill has been cut by at least 60%, from over $400/month in the winter to under $160/month.
Multiply that by five months and millions of home owners and you are looking at real money.
Of course, with all this success, here come the eco-freaks.
Too much traffic, destroying the roads, too much noise, water pollution {BS}, air pollution {BS}, and the best one of all, the drilling and all those people in the woods... they are frightening the deer.
This crap from the same people that don't want to allow deer hunting at all.
As a deer hunter for the past 60 years, I call double secret BS on that one.
The presence on men moving in the wild will change the deer movement but they will adapt and ignore the wells when the men move out.

The linchpin is Wickard v Filburn. It's a constitutional atrocity, and needs to be overturned. Do that, and you can de-authorize the worst of the federal agencies, along with such gems as the Assault Weapons Ban and federal Hate Crime laws.
It sounds like Perry has taken the right tact with the EPA. But does that mean Texas is NOT shutting down any coal fire plants, despite EPA rulings?
