The EPA's Unconscionable War on Fracking
The American Thinker ^ | December 21, 2011 | Jeffrey Folks

Posted on 12/21/2011 12:18:55 AM PST by Cincinatus' Wife

...When it comes to the EPA, it's always "heads we win, tails you lose." But that way of treating American citizens is not what the Founders envisioned or what the Constitution allows....

I suspect that the Pavillioin fracking case will eventually be dismissed... Again, the real culprit was an overly zealous EPA bureaucracy that seemed determined to further the agency's agenda of regulating, and shutting down, hydraulic fracturing -- and with it most new oil and gas exploration in America.

...And only after the EPA has secured its objective of gaining regulatory oversight of fracking on a national scale, which was the apparent objective of its speculative reporting to begin with.

At that point, the EPA will be empowered to bring unsubstantiated charges against every fracking operation in the country, thus delaying drilling and making it so costly as to discourage further exploration. That seems to be the hidden agenda behind the EPA's actions in Wyoming and Texas.

When federal agencies begin to wield power in an unconstitutional manner, depriving citizens and corporations of property in the most callous manner imaginable, one of our fundamental liberties has been lost. It is time for the EPA to be not only reined in, but eliminated...

When an agency begins to attack private citizens with no regard for the law, there is no limit to the damage that can result. Today it may "only" be the property of oil and gas companies that are at stake. Tomorrow it will be not just the property, but the life and liberty of all Americans. If the extralegal activity of federal agencies like the EPA is not curtailed, all Americans will soon be at risk of imprisonment at the whim of any one of the president's czars.....

Great article. The lyin bastards in the media and government are at it again. So many points to make from this article, but here is an obscure, maybe profound one.
with regards to the fifth amendment

“Today it may “only” be the property of oil and gas companies that are at stake.”

Is not the oil & gas under a person's “property” (land), his PROPERTY (possession). Property (of either type) are tangible assets that he can sell, like a cow, corn, or timber. If the government (illegally) prevents you from selling or decreases the value of your property, is this not a violation of your fifth amendment rights? I think it is.

Ok CW. I definitely agree with your guy on this one. He is right on energy policy.

...He is right on energy policy.

That he is. Spot on. And he tells it like it is about subsidies.

Presidential Candidate [Perry] Holds Agriculture Conference Call - NO subsidies -- Not on ethanol, not on gas and oil, etc. Cut regulations and let the markets decide. If states want to support businesses, that's their choice but keep the Feds out of it.

Each state is regulating hydraulic fracturing by creating their own rules, some based on the success of other states.

This is exactly what the Founders wanted by having the states be incubators of innovation.

True, in PA the "mineral rights" may or may not be owned by the owner of the surface land, but you know that before you buy property, it is noted in the bill of sale.

The development of the natural gas in the Marcellus Shale has brought thousands of jobs and billions of dollars of wealth to PA.

If you ignore Philly and Pburg, the unemployment rate in PA is 7% because the rednecks with our guns and Bibles that live in the middle of the state are making money from the drilling. The counties that surround Pittsburgh and Philadelphia have either banned or made it impossible to get permits for drilling so they get no direct money.

My personal home usage gas bill has been cut by at least 60%, from over $400/month in the winter to under $160/month.

Multiply that by five months and millions of home owners and you are looking at real money.

Of course, with all this success, here come the eco-freaks.

Too much traffic, destroying the roads, too much noise, water pollution {BS}, air pollution {BS}, and the best one of all, the drilling and all those people in the woods... they are frightening the deer.

This crap from the same people that don't want to allow deer hunting at all.

As a deer hunter for the past 60 years, I call double secret BS on that one.

The presence on men moving in the wild will change the deer movement but they will adapt and ignore the wells when the men move out.

OK, so it needs work.

I’m not sure how American most of these elites are, though.

We do not need the EPA “one-size-fits-all” approach.

One size fits all? Only in condoms and straight jackets.

(Although I find both a bit snug)...

“Big Oil” is “subsidized” and “green energy” is an “investment”.
You need re-education camp, comrade.

It will continue to be a game of whack-a-mole until the authority and legality of the EPA itself is questioned.

The linchpin is Wickard v Filburn. It's a constitutional atrocity, and needs to be overturned. Do that, and you can de-authorize the worst of the federal agencies, along with such gems as the Assault Weapons Ban and federal Hate Crime laws.

It sounds like Perry has taken the right tact with the EPA. But does that mean Texas is NOT shutting down any coal fire plants, despite EPA rulings?

Increased Greenhouse Gas Emissions Latest Target for Fractivists

http://www.rigzone.com/news/article.asp?hpf=1&a_id=113542

one well-pad fracking shale gas would emit more greenhouse gases than a community of 100,000 people in a year. Methane already accounts for a sixth of U.S. greenhouse gas emissions (GGEs). In addressing earlier concerns about the pollution impact of fracking Dr. Howarth wrote in Boston University’s Comment 14 September article, “Should Fracking Stop?,” “Many fracking additives are toxic, carcinogenic or mutagenic. Many are kept secret.

Let the games begin!
