I will say this: if these provisions are actually signed into law, I will support Ron Paul in the primary. I personally deem him to be the Republican least likely to use these provisions as President.
I’ve seen that one before. It is a good read.
Except for Rand Paul. Funny how the son of that much-detested oddball Ron Paul had the balls to stand against that. Also, the RINO Mark Kirk did, too. Blind squirrels and nuts and all that...
(b) COVERED PERSONS.A covered person under this section is any person as follows:
(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.
(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.
...and they then follow that up with this:
(1) UNITED STATES CITIZENS.The requirement to detain a person in military custody under this section does not extend to citizens of the United States. So, help me out if I am wrong here, but it sounds like the bill is for people who attacked or helped attack us on 911...or harbored those who did, or people affiliated with Al Quida or the Taliban who have supported them and carried out or planned attacks against the US.
And then the requirement for detention do not extend to US citizens. Now, that l;ast could read that they don't have to detain US citizens who fit the above criteria...but they would be permitted to.
If indeed a person is affiliated with Al Quida and /or the Taliban andm is in the middle of planning or actually attacking us...we would certainly know they were traitors and deserving of the death penalty. But proving it would normally be required. TYhere was no doubt about that guy. But trusting someone like Obama or Clinton or anyone else to always make the obvious call...is not something to triffle with. That's why habeus corpus, facing accusers, grand juries, warrants, etc. are important, to ensure it.
On the other hand, in a war and when a person has joined the other side...the rules of war allow that to be suspended for combatants...martial law type thing.
But that's not what they are calling this. it's like they are deciding martial law for people suspected of being affiliated with the enemy on an individual basis.

This makes me so mad.!

It's individualized suspension of habeas corpus. The constitution says Congress is empowered to suspend habeas corpus ...
The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.
And so, the constitutionality will turn on the meaning of "Rebellion or Invasion," and it may be found, by a court, that "rebellion" may be conducted by an individual.
At this point, at least Congress and the Executive are of like mind; and the case that I think is closest to showing the attitude of the federal courts is Hamdi.

You wrote: “Michele Bachmann recently appeared by Glenn Beck’s Internet show and stated that she, as a member of the Congressional Intelligence Committee, was even more concerned about the threat to our security than she was about the threat to our economy-and she is very very concerned about the economy to the degree that she advocates stockpiling survival provisions. It may be that there is something up of a truly serious security threat and Congress feels that it must set up a framework for a society in chaos, or in rubble? Bachmann, of course, said she could not reveal more.”

Catherine Herridge’s New Book — ‘The Next Wave: On the Hunt for Al Qaeda’s American Recruits’

The next wave of deadly terror is here and now. Washington shuts its eyes. And the next massacre in the name of Islam will be Made in the U.S.A.
TERROR WALKS AMONG US. Born here, raised here, plotting here, the terrorists of al Qaeda 2.0 aim to kill Americans. And our government helps.
Who are the recruits for the next wave? They live next door.
A radicalized army major guns down forty-five, killing twelve soldiers and one civilian; an airport shuttle-bus driver plots a subway slaughter; a legal immigrant tries to blow up Times Square while another fanatic hopes to kill hundreds at a Christmas treelighting ceremony . . . and a radical Muslim born in New Mexico has a legion of fanatics in his web.
The Next Wave reveals the shocking story of how that blood-crazed American, Anwar al-Awlakinow hiding in Yemenwas treated to Pentagon pomp as a moderate Muslim, and how our Justice Department hid his movements from the 9/11 Commission . . . even though al-Awlaki aided the 9/11 hijackers.
The terrorists next door turn our tech against us, exploiting Facebook, Skype, and our outdated laws. Online terror recruiters are one of the Webs greatest success storiesyet our government refuses to stop them. Activists howl about inhuman conditions at Guantánamowhile pampered inmates laugh at our weaknesses.
The next wave of deadly terror is here and now. Washington shuts its eyes. And the next massacre in the name of Islam will be Made in the U.S.A.
Written with no-nonsense clarity, moral rigor and hard-earned expertise, The Next Wave is a landmark in investigative journalism. This book by our most-relentless reporter on national security reveals in sharp detail how Washington’s infighting, political correctness and outright duplicity enable home-grown Islamist terrorists to attack Americans—by turning our own freedoms and laws against us. Fierce, first-rate and frightening. ~ Ralph Peters, former U.S. Army intelligence officer and author of Endless War: Middle-Eastern Islam vs. Western Civilization.

I agree. And if someone is definitively working wth Al Quida and the Taliban...in my estimation, they are in a state of rebellion.
It just matters on to what degree we are willing to go to “Prove” it. If it involves any kind of WMD, or mass casualtiy situation, we will be inlined to spend less time becasue there may not be much to spend before the attack.
Why would we trash the Constitution, and give the power to ANY MAN?
