Just checked out your claim, the open primary in CA ONLY APPLIES TO CERTAIN OFFICES...

congressional, state legislative and statewide offices,

IT DOES NOT AFFECT POTUS and therefore NOT ROMNEY. So you can go 3rd party.

More importantly, the ‘top-two’ system is on the ballot, not in effect yet. CA still has a ‘modified-blanket’ primary, which means that unaffiliated voters can participate in a party’s primary only if the party has historically allowed this (including Democratic and Republican until 2008). If I understand correctly, unaffiliated voters can vote in the Dem primary, but not the Republican one.
