Since when are Governors “private citizens” for the purpose of slander/libel?

I think she’s got a decent case anyway, but she’s not a private citizen. Her kids are.

I know Levin is a big hero to some,, a veritable voice of God, but “getting anywhere” can mean a lot of things.
First,, Random House will have to spend a lot of money to defend theirself. (come to think of it, the way SHE used to have to)
Next,,Random House is in an industry thats on life support already. They need bad press like a hole in the head, especially since Random House was always a conservative publisher until recently. In the late 60s they were accused by the left of being in bed with the CIA. Nothing like a well publicized lawsuit to let everyone on our side know what crap they have become.
I didn’t know until this story that they are owned by Germans now. Germans,,, a little nazi on one hand, big Obama supporters on the other.
The things you find when you get your attention directed somewhere.
Another way to “get anywhere” is that other smaller publishers might pause and very carefully consider the consequences of knowingly publishing lies.
Last,,, the future president is letting them know they are on her radar screen. That can have unhappy consequences that are still unpredictable. Their lobbyists will love that.
So for Levin,, “get off the phone you big dope”

Actually I just tried to get out the text from the pdf using NitroPDF, which I have used on other pdf documents from other people to convert it back to Word or Text so it can be edited. It didn’t work in this case, because it appears that it was a PDF of a scanned image, so the text can’t be split out.

WAIT A DOGGONE MINUTE! Wasn’t the alleged birth certificate of Obama (who is NOT a Muslim) a PDF made from a scanned image? How the heck did the words get split into different layers??? (I guess maybe that’s a topic for another day.)

Anyway, I haven’t yet been able to get the text from the letter out the easy way. Perhaps one of Sarah’s websites will have the text of the letter soon.

I think Sarah, and all conservatives, need to fight back aggressively. She needs to sue and put these people on notice that she will not stand by and allow herself and her family to be attacked with impunity.

Conservatives who just ignore vicious and false attacks end up being like pinatas. Everybody is encouraged to take shot after shot at them until they break. Then conservatives try to curry favor with their attackers and it just becomes self defeating.

Sarah should sue and let them know that if they attack her family she will not just stand there and take it. She should set the agenda and put her attackers on the defensive.

The left has to know that there will be a very high price to be paid for attacking Sarah and her family.

If her lawyers do have an authentic e-mail that shows that both Random House and Mcguines knew the allegations were false thereby showing the publication of these “facts” were known to be lies and that they were intentionally harmful (Malice aforethought) Palin does indeed have a winable case.

Given Obama’s, and the DNC’s, penchant/history for engaging in smear tactics like this book, a suit by Palin could be a pre-emptive move against their running a dirty tricks campaign against her.

We don’t have all the facts yet, but on the face of it, I would say that Palin is making a smart move in dealing with this and other potential smears that could be launched later on in the 2012 Presidential camp[aign. There will be no “October Surprise” against this woman.

Actually - it is a giant company - but I’m not sure a particularly profitable one - just going by memory - didn’t do my homework here.

But I think they are of the “Giant but break even” type.

$50MM could force breakup.

Not quite true. The ruling would be on her current status - not her future status.

Oh - and when the writer admits in a now-public email he wrote unsubstantiated crap, being a public figure isn’t a defense.

Isn't it better to surprise them with a subpoena or something rather than simply serving them notice they're about to be sued? Seems to me they almost certainly will destroy the most damning evidence el pronto. Instead of deleting emails they'll just melt the entire hard drive.

Not second guessing the Palin attorneys but just wondering how they can be sure no evidence was destroyed.

Well, Levin is not my hero, but he is an attorney and he knows a thing or two about the law, and I heard him say this briefly and dismissively when a caller suggested that Palin might bring a defamation lawsuit against McGinnis and/or the publisher. I mentioned his name because I figured most posters here would know who he is.

I’m not depending on him for the proposition that when you are a public figure you have a huge hurdle to overcome bringing a defamation suit. It comes from the case New York Times v. Sullivan.

So what Levin said was essentially conventional wisdom.
