The federal Illegal Immigration Reform and Immigrant Responsibility Act of 1996 “prohibits states from providing a postsecondary education benefit to an alien not lawfully present in the United States on the basis of residence unless any U.S. citizen or national is eligible for the same benefit.”

11 states have done an end-run on the federal law by allowing anyone who meets a residency requirement to get in-state tuition regardless of immigration status. Thus, it would be available to any US citizen if he/she met the residency requirement. There is an ongoing court case on the Texas law and bills were introduced this session in the Texas legislature to repeal the law.

It is illegal for illegals to work in the US and it is illegal for anyone to hire them. So why are we subsidizing their higher education? And it is illegal for them to collect welfare and other benefits, i.e., the dole. Perry's position on immigration and securing the border could very well end his chances of getting the nomination.

Ah yes, federal law, and we all know how well that is being enforced. Here is Arizona we arrest them and then have to turn them over to the feds who promptly release them to drive drunk on our street, rape and rob people in their own homes. Texas has decided that the kids who are going to school and want to be citizens should have the chance to do it. That’s their choice since the feds won’t do anything to help the situation.
