In my view, you are correct. The appropriation that exceeds the limit is not a debt--it only becomes a debt when money is borrowed. This argument is bogus.
In addition, in order to get to Court with this argument, someone would need to take the risk of being wrong and required to personally pay the money back. None of that is going to happen.
This is why Humma Abedan has said:
