Are you suggesting that when a case goes to appeal, and the one appealing wins, that this is a loss? Well, then, let’s just trash the entire system of jurisprudence.

It was telling, wasn’t it? Next would be, “....and if I lose on appeal, we wait until we see what the New York Times opinion is. If they don’t issue an opinion, I WIN. But if they do, and it’s goes against me, next we flip a coin 3 times. If I win 2 tosses, I WIN. But if not, then go go best out if five. Okay, so if I lose THAT one, then we play rock-scissors-paper 9 times. Okay, so if I lose THAT one, then we....” and so on.
