LOL. You are correct and it is as irrelevant as hell.

The officers saw him pointing his AR at them. They deserve the benefit of the doubt in that situation as they are the only one’s there.

If you don’t give the officers the benefit of the doubt in a warranted and legal situation, then you are just being legalistic. My reply to that would be simple. Prove he didn’t point the gun at them.

I’m sure some of the deluded actually believe that officers are just shooting people up for the kicks of it.

Not at all. Unlike you I am able to extrapolate from the actual known facts (as opposed to the assumptions you make and call facts) that there was no need for a SWAT team at all and that they acted like untrained ninnies carrying out their SWAT raid.

I would have to say YOUR statement is what is irrelevant. The real issue here is: why are heavily armed paramilitary teams being used to serve search warrants on citizens with NO record, and not even enough evidence beforehand, or even weeks afterward, to justify an arrest, as the police have readily admitted?

Good Lord, does ANYONE not know someone somehow connected to “trouble” in one form or another, past or present? Would not most men, awakened from deep sleep by a wife screaming that men with guns were trying to break in, not attempt to defend their family? I highly doubt that Guerena was even 100% awake when the bullets started hitting him — this happened in seconds.

Use of SWAT teams in this short-cut fashion, instead of competent police / detective work, is EXACTLY what is all wrong about this. It is a sure fire recipe for tradgedy and travesty.

(Have you read the story about the 92 year old grandma in Atlanta who managed to kill one SWAT team member and wound another before they hosed her, apparently still in her nightgown and using a walker?)

The “jackbooting” is not so much the SWAT team members themselves, though I must say they were beyond imcompetent. (If you watch & analyze the video carefully, Guerena could have easily blown several of them away if he really was a “bad ass” and prepared.) The real evil, or “wrong”, whatever you want to call it, is at a higher level.

No, the burden of proof is on the accuser, not the accused. That USED to be the law in America.
