Dramatic footage shows moment Iraq war vet was shot 70 times in home

A U.S. Marine who was killed when he was gunned down in his home near Tucson, Arizona, never fired on the SWAT team that stormed his house firing 70 times in a hail of bullets, a report has revealed.

The revelation came as dramatic footage of the shooting was released, showing the armed team pounding down the door of Jose Guerena's home and opening fire.

The father-of-two, who had served twice in Iraq, died on May 5 after the SWAT team descended on his home believing it was one of four houses associated with a drug smuggling operation.

I didn't know a warrant was a license to kill....

It isn't, however officers do have a right to defend themselves.

A ‘majority of states’ have crapped on the 4th Amendment and allow cops to enter a home for any reason or no reason at all?

Care to back that claim up?

PS: Just because one state $hits on the Constitution does NOT MEAN IT IS RIGHT TO $HIT ON THE CONSTITUTION.

So tired of this “Well, they did it so we can too!” childish mentality you’re exhibiting. It’s the first sign that the argument has no legs to stand on by itself.

Arizona has a provision for a no knock warrant to be approved by a judge. If they had one, they served it legally.

Does it escape your notice that NOTHING ILLEGAL WAS FOUND IN HIS HOUSE?

Yet they showed up like a frickin ARMY and shot him down.

If you think American citizens do not have the right to defend themselves from such brute thuggery, simply because they are outgunned by the thugs, them shame on you.

He was murdered. Government sponsored murder is not acceptable, simply because the State says it’s okay.

No, they weren’t caught in a lie. More likely, some team members THOUGHT he fired first, but then other team members corrected them, “No, that was me.” Had they been, they would’ve put the safety on, and never retracted their statement. I’m not sure what that matters, anyway: Correct me if I’m wrong, but I’m pretty sure a SWAT team doesn’t have to wait until being fired on to fire, that a gun being pointed at them is sufficient.

(Who points a gun at a SWAT team with the trigger off?)

I can’t tell you how many descriptions I’ve read of this which make no mention of the fact that he had a weapon in his hand, pointed at the police. Do you really think there’s any way the police could’ve known it wasn’t loaded or had the safety on?

Which is the correct place for a Marine to point his weapon when his door flies open? These amateur keystone cops, who couldn't even determine if his wife was in the house with children saw a weapon and opened fire. They unloaded over 70 rounds into a man who has served two tours as a combat Marine, who at least had the common sense to assess the situation before pulling the trigger. He saftey was still on, who do you think the amateur/wannabes in the that video are?

Keep defending this homicide. Clearly these guys were ITCHING for violence. It’s what they live for.

They shot an innocent man, and you defend it.

He had a right to defend himself against the thugs.

If they were acting on a “hunch” (which they obviously were) then why all the armor and bullets, and enough rounds to kill the entire neighborhood???

Because that’s what Police Statists do. In their minds they are God, and you better by God do as they say, or you will wind up a bloody pile of guts and goodlins, as this guy did.

If you want to continue to defend this, don’t waste my time. I find its defenders disgusting and Anti-American.

So do citizens. This story would have been different were I in his position. I say that as someone who has actually fired on other humans in combat.

Because that murderous, conspiring SWAT team PLANTED it there. Oh, nevermind... you’re arguing that we know they’re murderers because they DIDN’T plant any evidence.

They did leave the sirens on for several seconds, right in the driveway (I read people claiming that they couldn’t be hear because they were only on for two seconds, as if they were way down the street.)

Then your problem is with the issuance of the warrant, not with the SWAT team. Do you know the basis for the warrant? If it was that some neighbor saw a rifle, and the ADA and judge presumed that was basis for a warrant, then the judge certainly acted improperly.

Uh, down?

Don’t give me any nonsense about him not knowing they were the cops. When you hear a siren, a knock, then a fifteen second wait, THEN your door gets broken into, I suppose there’s a slight chance someone is doing a VERY thorough job of impersonating the police, but your best bet is yes, that’s the police.

So, are you saying that the police have to wait first for one of them to get shot each and every time they break a door down, even when they have a warrant, have announced themselves, and ran the siren for several seconds?
