In this case you are wrong. They were arrested for impeding an open business and that law doesn’t apply to preaching.

The law says it doesn’t apply to constitutionally protected activity, but preaching is not constitutionally protected in all circumstances. It’s certainly not protected on state property, like where the gentleman was standing. Personally, I think there were other laws they should have charged him with which fit the circumstances better, but there still was no civil rights violation.
