How can being a captive audience on public property make the first amendment be overruled. The recent SC decision in the case of the Westboro Church protests at a funeral went in the favor of the Westboro Church. I think those attending a funeral are more of a captive audience than those standing in line at the DMV. You may not like what is being said but the government cannot arrest the person doing the saying, just because of your dislikes, otherwise free speech is very costly. This free speech violation is going to be very costly: to the cash strapped State of California.

I believe the Westboro people are savvy enough about the laws to actually stand in the public way when they do their schtick, unlike this guy, who was on state property.

It is public owned property but the people are conducting private business that happens to be with the government.A street corner is totally public, you can walk on by or stay and listen if you choose to do so. Just because you think you have a right to say it does not mean I have to stand and listen to it.What if that was the Rev. Wright preaching his racist hate? Would that have been OK? If this guy wanted to get gods word out, why not just set up a small table and hand out pamphlets to those that might be interested instead of forcing people to listen to what some may find objectionable?
