I suspect this will never be solved. Saddens me to say, even voices on our side have no interest in pursuing this saying "we can't win on the issue" or "the issue has already been settled".
What kind of examples does the undocumented Obama past send? If you're powerful enough, the Constitution doesn't apply to you. Politicians won't actually represent their constituents interests if it's an unfavorable issue to the Media. The Truth doesn't matter.
