Pastor Terry Jones imprisoned to prevent Detroit Koran protest

The US pastor whose burning of a Koran sparked deadly violence in Afghanistan was briefly jailed in a heavily Islamic suburb on Friday after a court banned his protest outside a mosque.

A local judge jailed Pastor Terry Jones of Gainesville, Florida and his associate Wayne Sapp after a court found their planned protest outside the Islamic Center of America in Dearborn, Michigan, could lead to violence.

During his court appearance, Pastor Jones argued that the Koran "promotes terrorist activities around the world."

He also insisted that his right to protest against Islam was protected by the First Amendment to the US Constitution.

"The First Amendment does us no good if it confines us to saying what is popular," he pointed out.

But Dearborn Police Chief Ronald Haddad testified that his department had received information about serious threats made against Pastor Jones from local residents, and argued that his protest could lead to violence if allowed.

Prosecutor Robert Moran argued that the protest had nothing to do with the First Amendment and at stake were security and peace in the community.

The jury sided with the prosecution and Judge Mark Somers set bond at the symbolic amount of $1 each for the two pastors, which they initially refused to pay.

Following their refusal, both were escorted to a local jail. But local media reported both men changed their minds after spending about an hour behind bars and posted the $1 bond.

Under the judge's ruling, both Pastor Jones and Mr Sapp are now prohibited by the court from going to the mosque for three years.

But Pastor Jones was quoted by The Detroit Free Press as saying the two "will come back next week" to try to organise a new protest.

I'd prefer not to sink to your level. But, thanks for the invitation. I respectfully decline. I much prefer to walk in a bipedal manner. Perhaps you could commiserate with a muzzie in Dearborn and compare notes on how best to subvert America, Judeo-Christianity and Western Civilization.

That 1st Amendment sure is a pesky thing ain’t it?

If the moslems don’t like it, they are free to leave.

We may not like how some people exercise their Constitutional freedoms and God given rights, but in this country, we aren’t supposed to throw people in jail for something that they MAY do and the perceived consequences arising from them, real or imagined.

If the westboro freaks don’t get jail time, if al sharpton didn’t get jail time for inciting a riot in which actual and innocent people died, then why is it ok for this guy and not them?

Your post smells of fail.

The “local people” here is a Muslim police chief. The problem with “local” here is that Dearborn is a Muslim stronghold. The sole reason there is a threat of local violence is because Muslims are violent. It’s not the Koran burner’s fault. It’s Mohammed’s.

Muslims have to become civilized before they are allowed to live in a civilized nation. They will never be forced to adopt civilized mores as long as Islam is allowed to spread under the radar. Frankly, Koran burning is not my style. But people who force Muslims to reveal to the American public who and what they are, are doing other American’s a favor at great risk to themselves.

The Torah is the holy book of the Jews, the Bible is the holy book of Christians, and the Koran is the holy book for Muslims.

Did a goat screwing pedophile write all three or just the one?

Do all three incite violence or just the one?

It would be most offensive. But I accept their right to do it, regardless. Herein lies our difference. I am a Constitutionalist. Where you tend accept, or discard, whatever you believe to be right, or wrong, Constitution be damned.

Before you ask, since Islam is a cult of pedophilia, violence, polygamy, murder, mayhem, and evil, I do not accept it as a religion of faith. Therefore,it should not have the same protections afforded religions under our Constitution.

- I am not part of any "minion". I stand on my own and in full view.
- I'm saddled with nothing. I believe and support the constitution because it is correct, not because someone told me so. It is not my albatross, I am as proud of it as I am my own children. I find it both entertaining and concerning that you attempt to belittle those who defend the constitution by labeling their comments as "rants". It is troubling that there are people out there with a mindset such as yours. We demand equal rights under the constitution as individuals, not as part of any group. We will not have our rights trampled for fear of what someone ELSE may do as a result.
- Some of your arguing points may be factually correct, but are quite irrelevant. Fact is, this protest could lead to violence as you have stated and we ALL accept. More importantly, the speaker is not to be held liable for the reaction of the masses. The masses are individuals as well and are liable for their own violent acts.
- This thread isn't about obamacare, there are several hundred for you to choose from if that's what you wish to discuss. Appropriate analogies have been referenced that point to the blatant bias present in this case. It's only not obvious if you refuse to open your eyes.
- This is far more than a local battle for you. You can choose to make it about yourself if you wish, the rest of us "outsiders" see the broader picture and are thinking beyond our own front lawn and our own individual opinions.
- I've chosen to ignore the remaining condescending remarks, rebuttal would be fruitless in this case.

I realize that I'm late to this rodeo, but one can stipulate that Pastor Jones is a bigot, and still recognize that Dearborn crossed an important line in this case, and will, if challenged, lose.

There's good intel at Eugene Volokh's blog, and at Patterico.

I'll summarize: this is prior restraint, and won't pass muster under a litany of cases. The "community safety" fig leaf won't fly, either as it grants, in effect, a "heckler's veto" against Jones. The last straw to grasp is the "fighting words" doctrine which won't work as justification for restraint, either. Not legally, and certainly not ethically.

Bottom line is with the legal lines this clear, it will be very interesting to see how the courts treat this case. Hard to imagine that Islam is going to be granted special exceptions to the first amendment, at least right now.
