He should have run for reelection in 2008 because for 8 years the D’s were insisting he lost the election in 2000. So, in retrospect, since he didn’t ‘win’, he shouldn’t be ineligible for 2008.......

This amounts to the 0b0z0 regime, their media enablers and the union thugs taking “We the People” hostage. Case in point, Wisconsin and Ohio riots and violent rhetoric helped by activist judges who are ruling to stop enforcing the law legislated by duly elected representatives. IOW, elections have no consequences when WE win them.

The eligibility requirements explicitly state that "No Person" can be President who fails to meet them. This does not allow wiggle room at all for someone who happens to fool Congress or the voters into letting them into the oval office.
The Twentieth amendment, section three REQUIRES that a President elect submit proof of meeting the eligibility requirements to Congress and if he/she fails to do so Congress must name a replacement. If this "qualification" was indeed made, Congress would know about it and whether or not Obama was legal. There would be no mystery. Instead, we have nothing but mystery surrounding this issue. This means that the qualification was NOT made. If he did not "qualify", he did not meet the requirements of the Twentieth amendment, section three and we are stuck at that position. There is no legal President at this time. We have a usurper. You cannot make a legal President out of a usurper based upon a fraudulent swear in.

Anything passed along to us through someone who has taken the oath of office in Article six is certainly voidable. Their oath of office requires that they support this Constitution. Failing to ensure that the Twentieth amendment, section three was complied with makes them part of the reason why we have a usurpation. Ignoring the Constitution is not supporting it.
Another thing about your contention that is not correct is based upon the Fourteenth amendment's requirement that we are all equal under the law and that laws apply equally to everyone. How would this be applied in the case of a man accused of having sex with a minor who he assumed was of legal age? Everyone in the bar assumed that she was of legal age. She represented herself as such. The bartender facing charges of serving alcohol to a minor was fooled as well by her fake ID. Would this defense of yours save these folks from being sent to jail? If your contention applies anywhere at all doesn't it have to apply everywhere to be considered an equally enforced legal concept?
There is case law to show that these types of occurrences have resulted in jail time for those who "assumed" someone was who she was.
