The “birther” position should be that according to the evidence proffered to date, Obama is not a natural born citizen for the reasons you state. The only way he could be is if he had an American father. The only way to resolve THAT question is by seeing his long-form BC.
In light of all the questions that have been raised about the factual accuracy Dreams from My Father (not to mention its authorship), it has not been established beyond reasonable doubt either that Sr. really was his biological father or that he was born in Hawaii.
Because of the constitutional requirements regarding eligibility for POTUS, American citizens have a RIGHT to know this information. This right supersedes any conceivable right to privacy Obama might have about these matters. To claim otherwise would put Obama above the law. No person, ESPECIALLY the POTUS, is above the law. The question all birthers should ask of skeptics is “why do you believe Obama should be above the law?”
