The trick here is that this was done on the Assembly floor. Whatever punishment is meted out is going to have to come from the legislature, not the cops and courts. They have no jurisdiction over the legislative body.

Per my understanding a terrorist threat charge can stick if the person that is threatened “FEELS that they are at risk of great bodily harm.”
