Medical Fraud in Madison

David H. Janda, M.D. is an orthopedic surgeon based in Ann Arbor, Michigan and a member of a nine-member orthopedic surgery group. When he says " What these “physicians” have done is incomprehensible to those of us that uphold the Oath 24-7 year in and year out" - I believe him.

I am neither a doctor or a lawyer, but I can already see these unethical doctors hiding behind patient privacy (HIPAA) laws, saying they did indeed conduct an examination and diagnosis and "just try to prove we didn't because that is privileged communications between doctor and patient".

We have video proof of their actions, and they clearly conducted any so-called "conslutations" in public and within earshot of anyone who happened to be nearby. (Remember the "HIPAA line" at the pharmacy?)

So they can't have it both ways - either they failed to do a proper diagnosis - or they did so in public in violation of patient privacy laws. I'm sure there are hundreds of folks, including Andrew Breitbart, who will be happy to testify that they overheard "private medical conversations" such as "Walker Pneumonia".

Once again, liberals show who they really are.

Are the Doctors charging for these ‘diagnoses’?? If not, since they do not benefit financially from their activity, they are not, technically, committing ‘fraud’...

If a ‘teacher’ uses one of these fake documents to obtain sick pay, or sick-time, or to save her/his job/career, then he/she benefits financially and has committed the fraud...

The Doctors can, at most, be charged as accessories to the ‘teachers’’ crimes....

What is the aversion, in the Media, and on these FR threads, to calling it like it is — it’s the TEACHERS who are the criminals, here.....

These are not practicing doctors who see real patients.

The absence of 36 teachers from West Bloomfield High School on Tuesday has been deemed “a knowing and intentional abuse of sick leave” by district officials, who intend to withhold compensation from those who misused their benefits.

The absences occurred the day after a particularly contentious school board meeting, where several parents and educators expressed dissatisfaction with the lack of progress in the teacher contract negotiations.

As the number of sick calls began to mount, the administration moved quickly to provide adequate coverage for all of the affected classrooms. Substitute teachers were called, and administrative employees were brought in from other buildings.

“We anticipated that something like this might happen, and we were prepared,” said Pamela Zajac, public relations and marketing coordinator for the West Bloomfield School District. “Our number one priority was safety, with number two being that learning take place.”

According to Zajac, the administration does not consider 36 absences coincidental in a building where the average number of staff members using sick leave on any given day is approximately 12.

Yes, but there is something called conspiracy to commit fraud the Doctors are culpable in.

So what should be done, is charge the teachers, then work the way back to the doctors.

In the meantime, the Doctors should face a panel of their peers for ethics violations and removed from the university system.

By the bye, it may be terribly old-fashioned, and un-PC of me, but in the America where I grew up, criminals are not ‘docked’, ‘suspended’, ‘dismissed’, or ‘sent to bed without supper’ — criminals are arrested, prosecuted, tried, convicted, and incarcerated....

A couple of observations.

You are correct in that the "teachers" are definitely committing fraud with these "doctors' notes." No disagreement there.

However, the "doctors" aren't blameless either. There's a phrase for the act of writing a note for someone to be excused from work. That's called "practicing medicine." Doing it without a proper office visit and examination is probably against state and federal laws and regulations. It's malpractice at best (a civil issue) and possibly illegal by professional regulations, laws and standards.

If I were the employer in this situation, I wouldn't accept a doctor's note if there was no insurance claim for a doctor visit. I would point to the videos as evidence of rampant fraud and malpractice and want some records, vital signs recorded and office notes to accompany the "doctor's excuse."

If records of "office visits" start mysteriously appearing to back up these fraudulent "notes," and insurance companies start paying for the fraudulent "office visits," then the complexion changes even more for the doctors. I'm actually wondering if the information the "doctor" was gathering is to be used to falsify records and possibly make insurance claims.

I don’t, in any way, hold the Doctors to be blameless - I merely pointed out that, despite the headline of the original article, if the doctors do not realize any financial gain from generating these falsified documents, they have not committed the *crime* of Fraud... (That’s not to say that they have not broken other laws, or committed other crimes, in the process)

That particular *crime* is reserved for the Teachers who use these falsified documents for monetary gain, with the Doctors criminally liable as Accessories, or, at most, Co-Conspirators...
