Obambi and the 'rats were just hoping (and still are, given Kennedy's unpredictability) that they'd have the Supreme Court stacked sufficiently to allow it to happen. All they need it 5 black-robed traitors to say that it's OK and it is the law of the land.

If waivers are truly being dished out on a state by state basis, seems this would violate article 4 section 2:

Section. 2. The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.

(not that it would make a Constitutional authority like obama any difference)
