Unfortunately, two other states, Illinois and another pit of corruption state has ruled it Constitutional already.

I don’t think that matters. For one thing, these suits are attacking differnt aspects of the monster. And, one Federal judge can’t over-rule another — they are “Kings in their own realm”. It all waits until it can get on the SCOTUS docket, and I don’t see how that can happen until at least 2012.
What is important is that it is going to the Supreme Court and they will strike it down.
The Democrats knew it was unconstitional, just like they did the McCain-Feingold act.
Doesn’t matter, 2-1 doesn’t work like that when it comes to court decisions.
