The Obama justice department does NOT want to fast-track the appeal to the USSC because they are hoping Justice Kennedy will retire or die, allowing BO to get his 5th vote for this monstrosity.
The 2012 election is still critical.
There is no ability to proceed on implementing this law unless there was a stay of the ruling issued by the appeals court. As of this moment, there is no law to be implemented. Thus I think Obama will want a fast track.
