In the history of the United States, no court has ever drawn a distinction between a citizen by birth and a natural born citizen. For your argument to be accepted, a court would need not only to declare Barak Obama not to be a President, but would also have to declare Chester A. Arthur not to have been. The Constitution makes Congress, not the federal courts, the judge of the presidential election. Congess has declared Obama to be president and. like it or not, that's the final answer.

At least one state court (the Indiana Court of Appeals) was presented this issue by citizens who sought to have Obama's (and, oddly enough McCain's) electors ruled ineligible. The Cout's decision was cogently written and is worth your reading (unless, of course, the State of Indiana is also a party to this grand conspiracy). Google on something to the effect of "Steve Ankeny and Bill Kruse v. Governor of the State of Indiana".
