I don’t care if his superiors were commissioned by George Washington himself, the orders to deploy to Afghanistan come from the president’s authority, and no one else.

By the way, only the Congress can commission Military Officers, Presidents do not have that authority.


But Lieutenant Colonel Lakin wasn’t charged with failure to deploy to Afghanistan. He was charged with failure to get on a plane at Baltimore-Washington International and fly to Charlotte, North Carolina and then on to Fort Campbell, Kentucky.
If he wanted to challenge orders coming directly from Obama, he refused the wrong orders. He pleaded guilty to not showing up at two commanding officers’ offices.

It does not matter what plane he refused to board the offense is missing movement during wartime which according to the UCMJ is a capital offense and he can be executed for doing so.
