JUNEAU, Alaska (AP) --
A state court judge is allowing Sen. Lisa Murkowski to have a say in a legal challenge to Alaska's U.S. Senate race.
Attorneys for Murkowski argued that she should be allowed to intervene in the lawsuit that her Republican rival, Joe Miller, brought against the state over the manner in which it conducted the election. Miller contends the state did not follow the law, notably in its decision to use discretion in tallying write-in votes for Murkowski.
Attorney Scott Kendall said in court Wednesday that Murkowski should be entitled to protect her "victory" and have a say in the proceedings. Judge William Carey agreed to let her into the case Thursday.

Even if Princess Lisa eventually prevails, I hope Joe Miller is able to keep her from being seated until after January 3 just to deny her seniority.

She should not be allowed to be involved. This has nothing to do with her. It has everything to do with the bastardization of the election laws in AK. This is just a play so that when the judge rules against Joe, he can cite her BS argument about seniority and intent of the voters.

I'm not sure what effect Murkowski's failure to be sworn in on January 3, 2011 would have. But it would mean something, because she is whining about it. Her previous experience as a U.S. Senator would, of course, move her up. This would take precedent over the small population of the state of Alaska which would move her down.
At the conclusion of the November election, three senate seats were immediately vacant because they were being filled by appointments: Illinois (Obummer's old seat), Delaware (Biden) and West Virginia (Byrd). New York (Hillary) and Colorado didn't create a vacancy since the appointees had won the election. Of the newly elected senators, Joe Manchin and Chris Coons were sworn in on the same day, but Manchin ranks ahead because he was a governor. Mark Kirk of Illinois ranks behind both of them, even with his house experience, because the corrupt machinery either in Harry Reid's lame duck senate or in the state of Illinois, made sure he didn't get sworn in until two weeks later.
