I'm arguing that Congress has the only numerated authority of the rules and regulations of the Military.

Yes, the EO by Truman should have been challenged.

Was segregation the LAW, or just something the military did? If segregation wasn’t an actual legal requirement - but wasn’t prohibited - then executive order was a correct mechanism for its disestablishment.
