Despite what MSM and Murkowski says Alaska is NOT over: Miller can win with your help

The statute continues that “there are no exceptions” to this statute; “A ballot may not be counted unless marked in compliance with these rules.”

Unfortunately, it leaves room for 'legal' interpretation. Not for those of us who are reasonable, but for all the manipulators. Courts: this statute only applies to the 'marking' of the ballot correctly, the INTENT of the voter must be considered as to spelling and so on and so on.

I suggest the Tea Party in Alaska makes the following it's first priority: The Alaska legislature should ammend this statute.

Ammendment: "A ballot may not be counted unless marked in compliance with these rules, the name must be written 'as it appears on the write-in declaration of candidacy' Voter 'intent' cannot be used to validate ballots that do not meet the requirements of this statute. Intent is obvious, but the voter MUST meet the other requirements in order for the ballot to be 'valid'.

That should make sure that never again can the 'machine' or courts, or election supervisors write whatever rules they want! Of course, I'm dreaming that anyone would actually want a fair election....

I don't like sour grapes campaigns and neither do I like the wants and wishes of the voters to be dismissed.....

however, Cow has already changed election law by having her name on an official state list that was passed out or available to all voters...that was a change of law DURING an election season that should never have been allowed...

if people had to write in the old fashioned way, she would have gotten very few votes..

and of course, now they are changing state law to benefit a certain candidate DURING and election.....

how can that stand...

I don’t think he’ll get that many write in votes, but wouldn’t a vote for anybody but Cow or an errant vote be just as good?

If they steal this election from Joe and give it to the Murkowski brat who thinks it’s her seat because her daddy gave it to her, I hope there are enough Tea Partiers in Alaska to take to the streets.

I also think that if the radio campaigning done by the Tribal Chiefs on VHS Radio, is Public Radio, the new GOP Congress needs to defund their little radio station until they learn not to use it for illegal purposes.

Nope; not as good; it would require two times that amount because Joe would not be putting votes in his column; just taking them from Lisa.

Joe doesn’t need 5400 write ins. He needs a % of the write ins to be disallowed which can be overcome by his strength in absentee ballots.

I tend to agree (sorry!). I think it’s all up to the judge now, and whether or not the legal bill gets paid is not likely to influence anything.

Lawyers often work for months on end with little to no pay on big cases - I should know; I am married to one such lawyer :)

As a volunteer who waved signs for Joe, despite the campaign’s huge gaffes - I can say that I’m not willing to donate money at this point unless it’s a dollar that could actually help put the guy in office.

Actually, the list had to be requested - and I believe they kept some track of that, an only a small fraction of people even asked for it. With 50,000 bracelets, tattoos, etc - believe me, people didn’t even need that.

Lisa won in the bush - and it’s also in the bush that the electioneering occurred, IMHO. The Native corps had their henchman go to each village and basically force them to vote for Murkowski - and unfortunately, my husband says that Miller had to have caught them in the act doing that in order to have acted on it. But it also seems to strengthen the “protest” argument on misspellings...

My husband (AK lawyer for over 25 years) thinks that they should have brought this in state court, not federal. In federal court, even if somehow there are enough bad votes to matter, and they side for Joe, this can get kicked up to a higher court, where the judge or judges may be a bunch of liberals or RINOs.

I wish it were different but it looks like Miller will have to concede this week.

And where are the Military and Overseas ballots. This drives me nuts. I can’t find any info on this at all except a report the Military ballots are supposed to be counted on the 17th. Does anyone know how many were sent out? How many overseas ballots where sent out? Is there any place where they list how many they have received back?

From what I see, because of the way they talk about absentee and Military and overseas separately, then there must be more ballots, or did no Military or overseas resident vote??

Yes I agree with you, I haven’t read anything more about these, although I think there are still 15 or 20,000 between these and the ‘questioned’ ballots. Questioned ballots are not illegitimate at all - my own ballot for the 2006 election was questioned because they screwed up and didn’t have me listed on the registry for my precinct.

The magic number for a Miller victory is 10,800.
Each vote for Miller counts twice... once for adding to Miller's total, and once for not being in Murkowski's column.
Each vote for neither candidate counts once.

If x = Miller votes and y = votes for neither, then Miller wins if (2x + y) > 10,800.

Well, someone has to know something about these. It’s said the Military and overseas ballots count begins the 17th. But there seems to be no way to figure out how many went out or how many, so far, have come back. We need that info to see what the spread really is at this point.

its been very unfortunate that we know so little facts....

I believe the absenttees are counted already....I don't know if that includes military...

but with 93,000 votes that are write ins, Joe needs to get about 6000 votes OR Cow needs to get 6000 less than the total number...that would make her at the 87,000 mark and Joe has just over that....

no matter what, this has been a very close race...and Joe should use the law to get every legal ballot counted, and the illegal ones tossed....

suppose there a few more absentee ballots to count....maybe Miller could pick up 1000 more votes than Cow.....several things could swing this election....
