State wide election issues are usually filed in Federal District Court because at the State level the local court cannot make a ruling binding on the entire State. UNLESS the State Supremes make it known they want the case out of the gate.

"(11) A vote for a write-in candidate, other than a write-in vote for governor and lieutenant governor, shall be counted if the oval is filled in for that candidate and if the name, as it appears on the write-in declaration of candidacy, of the candidate or the last name of the candidate is written in the space provided...."

I think that pretty much covers the spelling variation issue. I don't see any wiggle room for subjective analysis of voter "intent" in that statute.

Every misspelled write-in vote needs to be tossed.

Bush v Gore pretty much settled the matter. You can’t change the rules after the fact.

I agree but I saw that the Federal Judge denied the suit. Time to appeal.

Or, maybe it's time for thousands of pissed off citizens to surround that federal courthouse and demand the firing of that judge. Enough is enough.
