This comes from a Vegas paper, so I'll summarize:
Day 1 of the inquest into the police shooting of Eric Scott at a Las Vegas Costco emphasized the large amount of prescription painkillers found in his body. The assistant DA suggested Scott was suicidal.
Day 2 apparently spent a bunch of time explaining why there will be no video...basically, the machines weren't working, sorry.
Then the cop who was closest to Scott testified. In his testimony, he says the gun found by investigators was in its holster, and that he didn't realize the gun was in its holster when he shot Scott. That info comes about 2/3 of the way into the article:

I am confident that your state has whorehouses however Nevada has state sanctioned (LEGAL) whorehouses. My mail lady, who works for the US Postal Service is married. Her and her husband made a decision quite a few years back that they wanted to pay off their house. She got hired as a stripper in one of the local clubs and in a little over two years they had the mortgage paid off.
Just because it is not something you would do doesn’t necessarily mean that it’s illegal.

I admit that ive been no saint in days gone by, but that doesnt change the fact that the vast majority of the encounters with leo over the years have been negative 'us vs them ' at the best, and downright hostile and in yer face on many occassions...
#3 is prolly the one that sticks me the most, and as another posted, the suit wearing critters up the food chain from the uniforms think theyre above the law as well...
this attitude breaks the notion of the 'good' cops being out there on the front lines, as if they are truly 'doin me a favor' for knockin 5 mph off a ticket that their wife or themselves wouldnt get in the first place...if theyre dishonest to their 'oath', how can they be expexted to police their own, much less respect those of us who are considered 'them'...???
ever been in rush hour traffic and have a marked car bearing down on yer bumper for literally miles ??? what do ya do, speed up, 'force' yer way to another lane etc...then when ya get outta his way, leaves ya in the dust...
I had traffic school instructor reply 'whos gonna give em a ticket' ??? the arrogance is mind-boggling...
i believe, for myself anyways, that in most cases turnabout is fair play...guilty until proven innocent, youre known by the company ya keep, etc etc etc...

I holstered two guns in five different holsters today to test this story.
You absolutely cannot pull the trigger and I might see this as surrender if I saw the gun still holstered I would command “Lay it down, NOW!”

I think so. The caption wasn’t definite. The cop testified that he owned one similar, and although he hadn’t tried it, he thought you could get your finger into the holster and fire it like that. I own one too, and I don’t think I can with a J frame S&W...don’t know about a Kimber.
A bit irrelevant, since he had already testified that at the time he fired, he didn’t know the gun was still in a holster...
my guess is that the initial call wasnt that bad, but the operator amplified it to the boys, who in turn amped themselves into a feeding frenzy...think about it, *IF* the dillhole rent-a-cop had sounded this kind of alarm, the LVPD would be makin damn sure that was released, to cover them from appearing all tooo ready to kill somebody...
also, *IF* erik scott was behaving in a manner that required evac of a rather large retail store, *somebody* else woouldve corroborated the story...again, even mr rent-a-cop seemed to say that although a bit upset, erik wasnt being even a bit 'menacing'...
AFAIC, curly can sweat and fry, unless he proves that he was indeed threatened by more than a citizen trying to comply or die...
Sorry luv, but you have no idea what you are talking about. I have a Nevada CCW permit and the permit is for a CONCEALED WEAPON. Permit class instructor, ex cop, ex detective, forensic guy and firearms instructor told us if we carry in a public place, like WalMart, (his exact example) "you better not reach up to get something off the top shelf and expose your firearm...you may have a SWAT team waiting for you when you go out the door".
That holds for any concealed weapon...its supposed to be concealed not flopping around for everyone to see.
In the picture the trigger is covered, but if he was holding the grip end with the barrel pointed toward me, and he was behaving according to testimony so far, and I had about a quarter of a second to make a decision, I don’t think I’d give him the benefit of the doubt.
I don’t doubt that Scott’s attempt to disarm was a poor choice. However, I’ve used this holster enough to say that removing it is different than drawing a gun. The clip - if it is identical to mine, and a number of people manufacture very similar designs - holds to my Levi’s pretty good. I need to take hold of the holster and wiggle it free to pull out both gun & holster. I also have to hold it in my hand differently than I would if drawing a gun.
Should someone notice the difference?
I can understand those who say no, but I say yes. It goes with the job, just as obeying the ROE while in the military was a part of mine. Also, at the distance, and with two other officers providing backup, it would be possible to step forward and grab the arm. Riskier? Not really. Shots to the chest are not guaranteed man stoppers - even a direct hit in the heart leaves a determined assailant with enough blood and oxygen for 10-15 seconds of conscious action, and that is enough time to empty a Kimber.
The instructor of my CCW class (an ex-cop) told of seeing a guy at midnight in a grocery store reach and pull a .45 out. He said he pulled his gun and was about to shoot...but the guy just didn’t seem focused. A moment later, the guy shoved the .45 back in his pants and reached for his wallet. The instructor jumped him, threw him on the ground, and slugged him...then called for backup.
THAT was admirable behavior! And that should be the goal - to have that sort of SA and restraint. Those that have it are the cops I admire.

There has been no testimony or other evidence at the inquest that such a recording exists. The plaintiff’s lawyer claimed that Costco had off-site backups (they probably do), but there’s no evidence that they have a real-time mirror of security videos (they probably don’t).
Thanks for your post but previous posts informed me that gun laws differ widely from state to state and that concealed weapon permits demand that weapons remain concealed. I didn’t know Scott’s weapon was a “concealed weapon.” Obviously if it was intended to be concealed it should have been. Aside from my ignorance of gun laws, my point was that even if one is allowed to carry a weapon in the open it could be dangerous for the reason stated by the expert you quoted.. And the same goes for an ostensibly concealed weapon that is allowed to be seen.
We may not know until Goodman calls his list of witness.
So, SnakeDoc, you don’t know who Horiuchi is, eh? That either makes you incredibly ignorant or a liar. I’ve been reading most of the threads on this Eric Scott killing, and can say that most of the evidence is yet to be revealed, yet you, in knee-jerk fashion, have denigrated the victim and praised the cops’ actions consistently.
That tells me you are an arrogant blowhard trying to control the discussion. The question is...why?
