Officer in Costco shooting says man raised gun, didn’t know it was in holster
Las Vegas Sun ^ | 23 Sept 2010 | Cara McCoy, Dave Toplikar

Posted on 09/24/2010 9:34:59 AM PDT by Mr Rogers

This comes from a Vegas paper, so I'll summarize:

Day 1 of the inquest into the police shooting of Eric Scott at a Las Vegas Costco emphasized the large amount of prescription painkillers found in his body. The assistant DA suggested Scott was suicidal.

Day 2 apparently spent a bunch of time explaining why there will be no video...basically, the machines weren't working, sorry.

Then the cop who was closest to Scott testified. In his testimony, he says the gun found by investigators was in its holster, and that he didn't realize the gun was in its holster when he shot Scott. That info comes about 2/3 of the way into the article:

they teach that in cop schools- yell your commands loud enough for all non-seeing ‘witnesses’ to hear.

problem is, if there are 3 cops all yelling different things and some of those things aren’t real...

I don't know what type of holster it was,

Early articles stated it was a zippered holster.

While the victim's use of painkillers doesn't provide any excuse for the men who killed him, it would explain why he was considered to have been behaving strangely.

It's possible - and this is pure speculation - that he, like many normal Americans, developed a dependency on drugs that were prescribed following a medical situation (like surgery, physical rehab, etc.)

That's much more plausible to me than the claim that he was "suicidal."

Purpose?

1 - If you are trying to commit suicide by cop - as the assistant DA has already argued - then you try to draw attention to yourself as a threat, forcing the cops to shoot you. You do not do it by exiting the store quietly, nor do you do it by pulling a gun out in its holster.

2 - I carry a J-frame revolver. If I pull it and shoot a guy who has a holstered gun in his hand, do you think the DA will argue it was a justified shooting because the guy was trying to commit suicide?

3 - I’ve never tried firing a gun in a holster. My daughter has a purse designed to fire the gun with it in the purse, but she has to stick her hand into the purse first. And I doubt Scott was carrying a purse. The fanny packs I know about generally have a tab you pull to expose the gun, but Scott’s gun was in his waistband.

It is true you can pull a gun out and have the holster come with it, but that ought to put a crimp in your shooting style! I think there are in waist band holsters with exposed triggers, but I sure wouldn’t carry one.

I don’t think the cops were trying to murder Scott. I think they fell into the “armed AND DANGEROUS” trap, led into it by the Costco employees. And the Costco employees admitted Scott was not acting violently or in a threatening manner...yet their call to the cops would lead one to believe he was.

That one earns the epithet “pig”. Or, perhaps, “warthog-faced buffoon”.

I’m not buying any of this. Too many eyewitness accounts within feet of Scott tell a different story. And Las Vegas has a record of lying/covering up.

Knock it off - he only has two chins. No reason to drop the donuts until you have three...

Actually, I agree. I expect an on the ball cop to make some pretense of physical fitness.

The murdered man is reported to be a West Point graduate and veteran with university degree(s) and a successful representative for a company that sells medical devices. This is mentioned in virtually every report I have seen until this inquest when suddenly he is a drug-addled, beligerent gun nut and very possibly suicidal to boot. It has been months since the shooting and none of this was reported until this inquest.

Technical malfunctions certainly occur. Amazing how this one just happens to coincide with this murder. This stinks to high heaven.

Doesn’t LAPD have any standards covering minimal physical requirements for its officers? I guess not based on the picture of the one who led the firing squad.

Just as they did with O.J. Simpson that ultimately cost them a conviction?

The officer who shot from the front needs to up his caliber to soemthing starting with a “4”, as in .45. Two shots center mass and the perp backed up and turned around before falling forward after taking five more rounds to the back. ‘9mm will not save you, friends, unless you can make head shots, consistently.’

From the article:

He also testified that he didn’t recall ordering Scott to “drop his gun.” But those commands are distinctly heard on the 911 tape that was played for the jury.

The tape was again played for Mosher, who said it was his voice on the tape. He was the only officer issuing commands, he said.

The following is heard in the 911 call: “Put your hands where I can see them now. Drop it! Get on the ground! Get on the ground!”

He refused to comply with those commands, to show his hands, or to get on the ground,” Mosher testified.

Uhm, officer Mosher, you also told him to "DROP IT!"

Nothing unusual at all in this investigation. The results were as expected. No surprises for the public.
