The only problem is that there don't need to be any presumptions of lawfulness.

Huh? How else can officers down the chain of command issue orders on a daily basis unless orders coming down the chain are presumed lawful?

Assume that Patriots recover Congress in Nov -(becoming more likely every day). The governors can reassign the newly elected Congressmen to take over from the outgoing members and avert any lameduck actions.

Before any impeachment there is discovery.
This will reveal (will only need a few days/weeks, not months) all that is necessary to remove Zero AND have him arrested and charged with sedition and lots of other VERY serious crimes.
The nature of the followup prosecutions for his fellow-travelers will be Treason and Sedition which will have relevance to all upper level Demorats and federal judges - a VERY long trail of tears.

Any and all positions Zero has skunked through will be subject to the reach of a vengeful America/Congress.
The Constitutional Crisis will be historic. The outcome will be bloody and nice and a lot of traitors are going under the bus before the meat grinding stops.

So what?

McInerny isn't a judge and has no legal expertise. An actual judge just pronounced his posturings as poppycock, which anyone with legal expertise already knew.

Accuracy and Red Steel hardly ever collide in the same sentence either. Still pitching the 'order to Afghanistan' nonsense, I see.

The article you referenced doesn't say whether or not Obama signed the orders. (It says he "ordered" the deployments.) Do we know if Obama actually signed the orders? I ask because ...

The article does say that the orders originally came from Obama and whether the orders was verbal or written, they carry the same weight. But according to your post about Larry Johnson's report, the military brass do not think so since they do not trust Obama.

The defense conceded that with the military judge’s rulings, the orders were otherwise lawful. With that this case is back to the standard case one sees where a Soldier has missed movement and disobeyed orders.

This is the takeaway line of the entire thread. LTC Lakin will be convicted as was entirely predictable when this sordid affair first began. He was a dupe of an ill conceived political stunt. He should be tending to the wounded and dying in Afghanistan who desperately need his superior medical skills. Instead he is playing silly little political games that are doomed to failure.

As for your remarks, I'll put my service up against yours or any other on these threads. The court observer is an experienced military attorney who is commenting on the legal issues and doing so quite well. Politics does not belong in military court rooms, a point that the judge made quite clearly today.

Now, do something useful and go work to get Conservatives elected in 2010 and Obama defeated in 2012.

I wish I could confirm Johnson’s report. I’ve been looking since May for a confirmation. I think it’s astounding.

IMHO, requiring your boss to sign off on orders indicates blatant hostility towards his authority. If there is that much open hostility between the CIC and the military one year into an administration, it doesn’t bode well for the remainder of his term.

Politics does not belong in military court rooms,

~~~
Neither do blatant disdain or petty
snarkiness, from an alleged legal
professional, when discussing this
legal issue.
God forbid, were I to have a son or
daughter who unfortunately needed the
services of military defense counsel
in time of war, he’s the LAST person
we’d ever seek.
Now, do something useful and go work to get Conservatives elected in 2010 and Obama defeated in 2012.
You must think someone elected you God.
Sir, I don’t take orders from anyone ..
least of all an online poster .. dictatorial,
arrogant delusional with fantasies of grandeur
or otherwise.
That would leave a ratio of 5:2 in favor of the conservatives or 4:2:1 if you consider Kennedy to be a wildcard.
Excellent deduction! However, would it even get heard to begin with? I've my doubts, based in history.
I'm afraid I'm with rx on this one.....I too have my doubts that SCOTUS will ever commit to hearing this case.
No, God forbid that you should have a son or daughter lying wounded on Afghanistan's plains, and the surgeon meant to save their life is in some Ft. Meade courtroom acting out some political stunt encouraged by the ignorant and clueless twits on these threads.
The MSM wants YOU and all like YOU to lose hope.
Don’t ever let the MSM have ANY influence over you in ANYTHING.
LOL
Right?
Another thing to remember -— are you meeting any of that segment of the population whom polls allege believe that BHO is foreign born?
I’m not.
However, people I know well, of all political persuasions, ALL of them are aware of the birth certificate issue and most of them are appalled.
But see.... in the same way that I’d never broach this topic with strangers, so strangers aren’t going to bring it up with me, and people aren’t going to discuss it in public.
So we have the impression that NOBODY cares -— but if the MSM reports that 40 percent of Americans do not believe that BHO was born in the USA, I’m sure that the number is much larger, just HUGE.
Anyway, that’s my current take -— it’s not that it’s politically incorrect to discuss; frankly, I think people are AFRAID of repercussions if the wrong people find out what they think, so it’s like it’s NOT safe to talk about it outside of private homes.
What are YOU doing on Free Republic?? That is NO way to refer to freepers. Did you lose your way from the Mega McCain blog, or from the Mega Whitman website or from Mittens Romney & Glennie Beck?
You obviously despise conservatives, and you obviously consider yourself a Superior Specimen of Humanity.
We don't.
On May 8, Larry Johnson of No Quarter (formerly with the CIA and U.S. State Department) reported that Pentagon officials are forcing Obama to sign off on Top Secret capture/kill operations because they don't trust him. Not being a military history buff, I wonder if that has ever happened before now.
This is VERY interesting!
Question: how can Pentagon officials "FORCE" Obama to sign off on Top Secret capture/kill operations?
What sort of "leverage" do they have to "FORCE" Obama to do anything he doesn't wish to do?
Why is the word "force" being used?
Perhaps more context would explain this.
I would be interested in your opinion, if any.
Do you have more on this story?
It just seems there may be more to this story than meets the eye.
Didn't president Eisenhower say "beware the military complex?"
Thanks ahead of time for your reply.
You are extremely RUDE.
Kindly stop issuing orders to your fellow freepers.
Free Republic founder & operator Jim Robinson is the only person allowed to be dictatorial, NOT you,
If you disagree with the Birfers or with the Birthers, please find another thread, and refrain from coming entering this subject matter to bash American CITIZENS who are deeply concerned with Constitutional Issues of eligibility.
Thank you for your anticipated cooperation.
