How much more damage can McCain do? Without McCain and his legal staff in the senate, Clair McCaskill (who was also on Obama's election team) and Pat Leahy, Chair of the Judiciary Committee, Obama wouldn't be president. Of course, Hillary probably would be. McCaskill, with her Senate Bill 2678, "to insure that children born to United States citizens while serving overeas in the military are eligible to become president" acknowledged with her bill that McCain was ineligible - you don't need a law to "insure" McCain's eligibility if he is indeed eligible. Since laws can't modify the Constitution, her bill was a "head fake." She set the stage for the coverup of Obama's patent ineligibility, because, with McCain running, Repubs. daren't say a word about Obama.

McCain has been through ten years of Congressional hearings on his eligibility, which, fair or not, were never resolved in his favor. Had McCaskill been serious, she would have tried an amendment; but the record for amendments to Article II Section 1 is 0 to 26. This was McCain's last shot. Without McCain in the race some congressman or senator would have responded to the thousands of questions about Obama's eligibility before the election. Since SB2678 was a red flag for McCain's problem, and had no legal effect, Leahy and McCaskill, in April 2008, filed a resolution, Senate Res. 511. It avoided McCains problem and stressed his positive qualifying attribute, two citizen parents. Every Senator signed that resolution, inluding Obama, who does not have two citizen parents. They all know and should all be reminded of their violation by whatever means we have. As John Marshall said, "we are a nation of laws, and not of men." Sadly, that is not currently the case.

One of those who asked was Retired Naval Commander Kerchner, whose subsequent law suit charging Congress, Cheney and Pelosi with dereliction has been in the courts for over eighteen months. Another who asked, Georgia Congressman Nathan Deal, got an answer - ethics charges. That was the warning to the legislature. Lou Dobbs was the warning to the media. McCain is Obama's enabler. Damage being done to our nation was, and still is, his to stop. He knows the law. Most people haven't had the time or interest, and/or were victims of the disinformation campaign, afraid that the Ruling Class would call them names - "Birther", or "wingnut."

As the principal author of the 14th Amendment John Bingham told us about natural born citizens, "...of parents not owing allegiance to any foreign sovereignty..." McCain's parents fit that requirement and Obama's didn't. McCain happened not to have been born "...within the jurisdiction of the United States...". While I think we should amend that provision, it is our Constitution and John McCain knows it very well. He has major responsibility for millions already suffering under a man whose allegiance is to another nation and another set of principles, principles about which even Charlie Rose and Tom Brokow have no clue. Our founders and framers were prescient and we are paying for ignoring them.
