The guy knowingly made a misrepresentation of fact in order to obtain a social gain. That pretty much meets the definition of fraud and fraud has never before been considered as protected speech.

So is claiming you are a surfer or wearing a padded bra.

Does Congress have the right to make those fraudulent claims a crime?

If so, under what section and under what clause?
