Okay, an admitted addendum... "6 identical visual depictions" may not refer to multiple files on the same Photo CD or multiple copies of the same "summer stupidity in Belgium" Photo CD, but rather 6 physical photos. I will confess I don't actually know how Texas law treats that question.

That said, I still think that the doctrine of "X number of images equals a presumption of malicious intent" flies in the face of Anglo-Saxon legal tradition: "Presumed Innocent until Proven Guilty".
