The Constitution is NOTHING, huh???
OK, kids. Let's pull out our Constitutions and actually read the document. The power to raise an Army is exclusively Congress's and is not the President's. The Army is not some private Blackwater that Presidents have raised. There are a series of laws Congress has enacted that establish and organize the Army. They're in Title 10, U.S. Code. Look it up. The authority of the officers of the Army, commissioned and non-commissioned, is Constitutional and flows from these laws. There could be no President in office and their orders would still have to be obeyed. The orders Lakin got were not from Obama and were perfectly legal.
How far are you willing to take this? Last year's class of officers were given their commissions by Obama. Are you saying their commissions are invalid? They aren't really officers? Do they owe their pay back to the government? Can Private Beetle Bailey tell his butter bar to shove it, he doesn't have to walk guard duty because his officer was appointed by Obama?
Read your Constitution. Like it or not, he was elected by the Electoral College whose votes were read out in Congress. He was administered the oath of office. If he is not Constitutionally qualified for office at this point there is one remedy for that - for the Congress to institute impeachment proceedings.
Nothing in the Constitution empowers the Army to judge the qualifications of a President. Nothing. In fact, the Constitution makes clear the Army is subject to the control of the civilian government, not vice versa. We don't do coups in America.
In my opinion Lakin and his supporters are damaging the institution of the Army by trying to put it in a position to judge the President's qualification for office. It needs to stop.
