can a judge dictate civil law between a private loan contract and individuals involved in legal default proceedings covered under the terms of a legal and binding loan agreement?

This “judge” just declared all previously legal and binding sales contracts to be void. He has appointed himself to be above the law and in essence, he now IS the law.

OUTRAGEOUS!!!!

The judge is correct in that the separation of the promissory note from the deed of trust renders foreclosure by the party seeking to do so illegal under Utah law.

In other words, the contractually obligated parties are the home buyer and the holder of the deed of trust, with any third party having no legal standing to foreclose.

They're going to have to backtrack and untangle their own money-grubbing nightmare in order to take back the property that was "decollateralized" by their actions.

So you believe that Utah law does not apply to BofA when it does business in Utah?

The judge is applying Utah law as written, not inventing it wholesale like you imply.
