To the police officer, the fleeing suspect was a felon involved in a violent crime. He had no reason to believe otherwise. The suspect shouldn't have chosen to run... The police officer had no reason to believe he was a fleeing felon. The standard is not "guilty until proven innocent."

The police officer had no reason to believe he was a fleeing felon. The standard is not "guilty until proven innocent." For a court trial someone is presumed innocent, but that isn't the legal standard for a police officer to use force to subdue someone.
