That’s the argument you should use to attack it. The court ain’t gonna overturn this on state’s rights because it’s really hard to argue how this affects it under modern legal interpretations. This, on the other hand, could get them to throw it out with probably a few liberal justices joining in.
Actually, the states have a very strong states' rights case, in that, under this law, they are mandated (forced) to set up and administer the public exchanges.
