Hoyer: Not at 216 yet
Countering some of the "we've got it" optimism of several colleagues, House Majority Leader Steny Hoyer seems to be saying that Democrats do not yet have the 216 votes they need to pass health care reform.
"Were going to get those 216 votes because we believe that they understand that Americans want health care reform by an overwhelming majority," Hoyer said on NBC's "Meet the Press."
When host David Gregory asked Hoyer if he has the votes now, the Maryland Democrat said: "I think were going to have 216 when the roll is called, yes."
Gregory: "But not yet? You're not nailed down, a few behind?"
Hoyer: "There are still members looking at it, trying to make up their minds, we think 216 plus votes when we call the roll.
I just got an e-mail notification from CNN that according to blah blah the demorons now have the 216 votes... Welcome to Amerika

The outcome of any vote by Congress on health care is irrelevant since Article 1 Section 8 of the Constitution does not specifically grant Congress the power to regulate health care! Therefore the so called legislation on its face is Unconstitutional! The people are not bound to comply with an Unconstitutional act of Congress! This is a power regulated to the states per the 10th Amendment!
It is the reason why Idaho and Virginia have passed legislation blocking federal health care from being illegally imposed on the citizens of those states by reasserting their 10th Amendment rights and 34 other states considering similar legislation! This is the point people need to hammer home with their Congress critters!
I find it hard to believe that this would be coming to a vote if the DemonRats didn’t have the numbers. This was supposed to be all wrapped up in August, they’ll slow-roll it as long as they need to.

If this is true, Hoyer is waiting on the Stupak deal with Obama and his executive order, etc. to give him cover.
Not caving...he has always planned to vote yes if his party needs it.

They’ve had it all along. Anyone watching the Fire Dog Lake blog as some kind of barometer is a kidding themselves - she’s just recording when they announce which way they will vote. She doesn’t have info on the “Un-decideds”. There never were any such things. Stupak and his group will cave; they will strip the Medicare cuts once the bill is passed. And we will have Obamacare by sundown tonight. We cannot stop it because they have no interest in listening to us.
I would be surprised if he sells out now.
They probably have about 220 and right now are working on who are most vulnerable in November and deciding who won’t have to vote for it.

What would the effect of Stupid Stupak and the EO be on the Senate?
So how do we "opt out" of the taxes that are going to be heaped upon us once this unconstitutional law is passed?
My wife and I were talking and we deemed that our taxes were already paid for this year and passed that into law!
Where do I go to legally challenge this as a common citizen?

I think his district is safe. When liberal Catholics in his district have to chose between a possible hell for babies like Romania, one of the worst under communism for abortions, or the union and their govt goodies - the babies lose everytime.
It seems to me that an EO that truly and effectively bans money from the Senate bill going to abortions or abortion coverage would have the same effect as a line item veto, except the two houses would not be allowed to over-ride.

I don't think the Senate will pick this back up. If this passes today they will have what they want and have no need to get back into the mudpit.
