It can’t be implemented if it is under legal challenge can it? I don’t think it can.

I don’t think so. The Partial Birth Ban was tied up in courts for forever......Here’s hoping. Because if you can delay the instant gratification, it’s going to be easier to repeal.

The fact he intends to sign it on Tuesday tells me it can be implemented until all challenges are exhausted. I hope I’m wrong.

What makes this bearable, what helps keep me from despair is Free Republic. Knowing that there are millions of true Patriots in a time such as this and that I and my family are not alone, is a balm to the spirit.

I will REMEMBER IN NOVEMBER.

A court doesn’t “repeal,” it “strikes down.” Krauthammer is speaking of a different scenario if it passes court muster and has to face the political process again.

If a showing can be made to the court there is a reasonable likelihood the challenge will prevail, the court will probably issue an injunction, barring the law from being enforced, while the litigation proceeds.
