Could these gentlemen petition for a Grand Jury hearing and when the Grand Jury is done dismissing the case..

In the case cited I wouldn't count on the Grand Jury dismissing the case...particularly if the jurors are from the *Upper* West Side.

Agreed. Some where at some point someone will have to make the stand. Get the law reversed and establish precedent.
