Throughout the Constitution it expressly refers to "persons" having rights, though mostly in the Amendments (not excerpts to the Declaration of Independence which you posted earlier...and which have no legal authority)
Until, or unless, you get a USSC decision stating a fetus is a person you have no legal argument.
That's not to say you don't have a MORAL argument. That's only to say your contention that the US Constitution expressly protects the unborn is fallacious.
Therefore, the available remedies I mentioned earlier are your only option...judges (personhood), judges (10th Amendment, fighting in the states) and armed revolution.
