It was starting to look like Reid's plan was to make Scott Brown run in 2012 as "Senator elect" (but that would require Reid winning re-election himself).
It seems like any bill which passed only because Kirk voted for it, since the election, could be challenged in court as invalid, since he should not have been allowed to vote. He's not legally a senator any more.
