You need to read the Judges’ statement from 2 days ago. In it he had things to say for both sides. What he told Orly is that he was concerned about standing, AND that he would have suggestions to Orly should he dismiss the case for lack of standing.

The Judge has to look ahead at what will be presented to the appeals court. If he allows the case to go forward, Obama’s lawyers will be in appeals court the same day motioning to dismiss based on lack of standing.

Do we know who Obama’s lawyers are specifically? Is it a private firm or Justice Dept. attorneys? Who are the specific individual lawyers who are representing him? Who the hell is paying for all this? Is this information in the private domain? Thanks!

Unfortunately, that would be the infamous "Ninth Circus," to borrow a joke from Rush Limbaugh.

One positive thought, though: It's difficult to see how they can rule that a military officer (faced with the real possibility of receiving orders from a commander in chief whose constitutional qualifications for POTUS are in dispute here, and who has pledged under oath to follow the Constitution) does NOT have standing to ask a federal court for this issue to be resolved.
